ESP Eclipse problem

I recently picked up a used ESP Eclipse II. I have a strange problem. Notes on the low E string from the first until the 5th fret are sharp when the guitar is properly tuned and intonated. The other strings are fine. My only guess, is that the nut slot for the low E isn't deep enough. Does that sound plausible?

Hmm, that happened to my friend's guitar but I think it was a problem with the frets not being leveled well enough

Don't those have some sort of compensated nut? Maybe it's got something to do with that . . .

I know some of the LTDs have the Earvana compensated nut. This one is just a regular one.
