If you take it to a good luthier, he should be able to replace a few frets, grind and polish the rest and let you go. You're in Connecticut? You should at least bring it someone like Giuliano and get an idea of how much it would be to:
1. Refret
2. Grind and polish
3. replace a few frets and polish as needed
He's a bit expensive, but he does good work. I met Peter Frampton in his shop about 20 years ago, and he was having fretwork done. There are lots of other really good places in the NY area though, so if you love the guitar I'd just keep it and fix the frets rather than returning it. I know a guy in Manhattan if you want to travel that far, too. He does simply amazing work (and is the only one who sees my guitars).
Good luck with whatever you choose to do, but I'd keep the guitar and fix it if the only issue was the frets. If you can tell it's special, keep it. If the frets are just the most obvious bit of why it doesn't really inspire you, then I'd bring it back.

2.be carefull about what brand of fretwire you are going to install
i refreted my jem7vwh with dunlop 6105 and.....
its not the original fretwire.
4.noone knows what kind of brand is the original fretwire,the only think i know its w6105,what the hell is (w)

I haven't refretted a VWH, you'd be better off asking somebody that has. It would make sense if it was but I certainly couldn't say without doubt it is.

I heard (I'm pretty sure it was Jim Donahue) that the W6105 is Warmoth's. If Ibanez doesn't use Warmoth to purchase it, it's at least the same wire that Warmoth sells. From that pic I'd say 100% that it should be refretted. I can't tell you just how much I oppose partial refrets. The only reason I accept for a partial refret is if one fret (maybe 2) is damaged from a fall, or if it's a newer guitar and one was over-levelled because it wasn't seated well. Then you can get a good match. But it's pretty hard to match the fret heights of the new frets with the previously levelled and possibly worn down existing frets. It's an opportunity to level the board and start clean. Also you have no idea how much compression is in the old fret slots. So if you're talking about 5-7 frets like the pic, you could be putting the propensity for an "S" curve into a neck by fretting that section "your way." It's just an opinion, and you can disagree or tell tales of successful partials past. But for that many frets in that "high traffic" area, I don't think there's any upside to a partial refret.

W6105 does indeed stand for Warmoth . Warmoth 6105 Frets are what comes on the Jem 7vwh's, not dunlop. Its important to use warmoth's and NOT dunlop because dunlop fretwire isnt the same size.
