The point is once you cur the wood and you hit flaws, and the appearance changes from the mockup, you stop and check with the customer, not just carry on regardless. If he'd emailed or phoned me, then fair enough.

If you compare the mockup with that piece of wood and look at it closely it is not the same quality. The darkening stain around the edge was supposed to be subtle, not in your face like the EVH, the finish would highlight all the flaws.
Mr Woods is the expert with the actual wood, he should of cut it, wet it, and sent me a picture to OK if there was any doubt at all.

This has gone way past the point of assessing blame. Chris will not finish the work or go any further with it so this is about ending this deal. He has evidently already put this offer on the table.

Rich, this 'venture' owes me $4735 PLUS interest @627%/month since Oct 04 when I paid to send the Uv777 for him to reference, plus flights and legal fees, plus paying to ship back my gear, including tax, vat and customs charges.
The UK lawyer was $500/hour, the usa attorney was $275/hour. I paid Chris all the money upfront, I had to pay for the topwood twice, and buy a trem from Japan which I'd already paid Chris for once, as he wouldn't get it.
The parts are redundant and i will have the aggravation of disposing of them at a loss.
You are a business man, total that lot up, then give me view on what I should do.

You will not recoup any interest or any legal fees. There is NO customs due on RETURNS. There will be customs due on anything new that you aquired during this "venture". Those fees are yours, not his. The parts are evidently a part of the difference between the $2700 and $4735? Any parts he was directed to purchase for you are yours, they were purchased at your direction, what you do with them after you receive them is your business.

Hi Rich, Thanks for the reply.
I am a bit confused here, the attorney wrote 'the court would award costs and interest as it sees fit, and to which ever party it considers appropriate'.
Anyway the only way I can see out of this is either to go to court or to do the guitars, I'm beyond careing which to be honest.
I've no problem with chris carefully finishing the guitars, or with a legal agreement to cover this.
I had to pay him for the tremolo twice and the topwood twice so I also would like that money back.
Anyway see what you can do,

If you want to proceed to court then get offline, get your court date, book your tickets, and pay thru the nose to accomplish nothing but line your lawyers pockets. You cancelled the order the way I understand it so you will not be awarded anything but straight refund.
Now, if you want to put an END to all the bull****, you have a mediator willing to stick his nose in [briefly] to try and help this resolve. Unrealistic demands will make attention quickly dissapear.
Chris has already stated he will not finish the guitars. This is at a refund point, and his offer is on the table. If it isn't fair then state exactly why.
