Since he amended the ad to omit the hardshell case 8 hours before the end of the auction, you may be out of luck.

If you put in a proxy bid, and the ad was changed after your bid was in, i would ask for a discount on the final price or substitution of a case of equivalent value. If the seller refuses, i would take it up with eBay.

If you placed your bid after that amendment was made, he's probably under no obligation, since the terms of the sale were there in writing (however small and inobtrusive as compared to the ad text) and any "deal" you'd like to make on a case is then entirely at the seller's discretion.

Personally, i think the seller making a change to the auction that late in the game (especially one that materially changes the value of the item for sale) is a little shady.

For the record I did the buy it now thing at this time; 31-Oct-03 20:28:15 GMT.

The auction was not due to end until 04-Nov-03 06:47, and so I am forced to conclude that either this guys server is a. full, b. screwed, or thats what hes trying to do to me!

I dont know really, I never did this before, I'm an ebay virgin pretty much.

Does somebody know anything about this exact guitar? ie can you match the serial to check its cosher etc

I really wanted this damn guitar! But I can't sort out any of this stuff if my emails dont get through and as its LA and I'm UK the time difference and cost of the call is prohibitive to telephoning the store. Has anyone else been/heard of anyone being in this or a similar situation.

Advice my Gurus, before I have to go to war on what may turn out to be a legitimate retailer.

His feedback doesn't say he's a scammer, and the auctrion was updated as Darren pointed out [not like I would have caught it either though]

The error message you got just means that your mail server could not connect with the recipient's mail server. This could happen for any number of reasons, but the main one would be that the receiving server is down.

If the seller's lack of communication is because of a technical problem beyond his control, try contacting him through an alternate channel. I would pick up the phone and call him. Be nice. He might not be aware that his mail server is down or that you have been trying to contact you. Or he may not be able to send email either.

With regard to the case, by doing the "Buy It Now" after he changed the ad, i'm afraid you don't have much of a leg to stand on when it comes to the case. The change to the ad withdrawing the case was there in the ad when you pulled the trigger. If you didn't read the whole ad carefully or didn't see it, there's not much you can do.

You can always ask nicely and see where it gets ya.

Nothing was mis-represented. The fact that the auction was still scheduled to run for a couple more days after the change was made lessens the shadiness somewhat, though i think he should have either completely pulled the auction and re-listed, or at least made the change as prominent as the rest of the text in the ad.

Ok boys, we're getting things moving. His server WAS down and thats why my mails were being returned. (So shoot me, I'm nervous on my first time lol!)

Am getting him to order me the case as described and have suggested a trade+10% deal as the adjustment is a little shady as everyone seems to agree on. What do you think Rich? You are the guru and obviously the King on customer service when it comes to your business, is that the sort of thing you'd do?

Anyway, I shall update y'all soon on the progress of the deal.

PS Does anyone know how to match the serial to verify it is a cosher guitar and not a chop shop job, also get dates of manufacture and thus clarify changes in spec?

Can't wait to be a JEM owner. Is it as good as being a PGM owner? :P

Still unsure about matching the price?! ha ha joking

Anyway, checked out your site and you have some nice stuff. I'm interested in the 90 you have actually so dont go polishing the guard just yet!!!!!

Progress being made on the deal and hes checking on the status of case orders.

Wish I had a guardian angel like rich around all the time.

Finally got ma baby


It arrived after all the nonsense! Paid a total of US$990 incl. an ibanez moulded hard case, international shipping, insurance etc. Arrived Xmas eve! What a present. Only thing was it arrived without allen keys and a trem arm. No worries I'll order them soon.
Well boys it finally happened, I got my first JEM, and for a floor model was v nice! Only two small dings on the back which you have to look for to find. A very good deal. Hope more people get deals like that.

PS Rich, I'm still thinking real hard about that 90th anniversay model! Maybe we'll talk some turkey soon. When I get paid of course!!!!!
