my first and worst *bay selling experience


I recently sold my dead mint Jem 15th on *bay. The person to whom I sold my guitar emails me after receiving the instrument saying it is great. Then he asks me about polishing scratches, which I had not noticed to be significant, and fogging under the guard near the edge. I reply to his mail with two explanations: Minor polishing scratches on the guard must have gotten there when I polished it. The fogging must be either moist from polish or fabric pattern. The reply I got from him was rather positive saying he'll try to wipe the surface under the guard. There was no request for pickguard replacement or refund. His focus seemed to be clearing this "fogging." After not hearing from this guy for 6 days or so, he write me saying he wants a full refund bevause the guitar's not in the condition he expected it to be. This was at least two weeks after receiving the guitar. Of course, I refused and offered to send him a new guard if he wants. He accepted my kind offer but there was something I wanted to go over. The fact that he mentioned nothing about fogging underneath the guard was a but suspicious. After exchanging several e-mails, I learned that this simpleton wiped the surface "on" the guard not under it. Obviously, that'll cause extensive surface scratches on the guard. Now what once was a peripheral issue turned into a major issue and he blames me for ruining his guitar. Too much for listing a brand new, unplayed condition guitar on the bay.

The buyer doesn't know what he is talking about...

Save up those e-mails where he admits his noobish behaviour.

If paypal contacts you, just explain the situation. You should be in your right.

I wouldn't worry to much about the paypal claim.I recently filed a claim against a seller after 6 weeks past and nothing was recieved and all my emails remind unanswered. needless to say that 10 days passed without a response. then i recieved an email from paypal saying they ruled in my favuor but at this time they can't withdraw any money from the sellers account and they are closing the claim and I got nothing. So apparently you can avoid those claims somehow. don't know how he did it but I guess if you empty your account balance, then you might be ok.

He should very much worry about the claim.

I filed a claim against a seller. PayPal was unable to retrieve any money from the seller's account, but they still refunded my $1500 and said they will continue to go after the seller.

PayPal doesn't just lock up your PayPal account. They'll lock up the checking account you have attached to it as well. I filed a claim against another seller because after 2 weeks of no responses to emails, I got no guitar and no tracking number (I was still paranoid from the previous experience). Two days after that, the seller was VERY responsive. They begged me to dismiss the claim and gave me the tracking number because their primary account was locked up.

That, I don't know. I bought a guitar and within 2 hours I had 3 messages informing me of the same guitar in other auctions, so I filed my claim within 24 hours. 6 weeks is a long time, and I don't know what the rules are as far as time limitations.

If it's any consolation, I'm hoping you get your money back.

According to paypal, the time limit is 45 days from the time you sent the money. After 45 days you can't do anything. I waited untill the 44th day (because I'm nice and have faith in people ) to file my claim. so I'm still in the legitimate time frame.

I heard from Paypal today saying that it has been resolved in the buyer's favor. I was outraged. They said e-mail evidence is not considered valid. When I asked them what other "valid" evidence the buyer had, they didn't comment. The following are the e-mail exchanges I had with the buyer. Does it look like a dissatisfied disappointed buyer?

Buyer: Guitar is great. I do have a question about the pickguard and the fogging/scratches on the underside around the bottom edge. Do you know what that is or how it got there?

Seller:As for the fogging under the guard, it may be either moist or unusual fabric finish. I noticed it but never removed the guard to find out what it really was. If it bothers you, loosen the bolts of the guard, and try to wipe it. If it is not the fabric, it should come off. If it is moist, I am thinking it must’ve got there when I cleaned the guard with guitar polishing liquid. Nevertheless, the guitar has never been tampered with. Trust me. The polishing liquid may also explain some dust/polish scratches. As I mentioned before, I only dusted and polished the guard without playing. That should be obvious from seeing no scratches on the pickup covers. If you have any questions, feel free to e-mail me.

Buyer:Thanks for the information. I'll try that this evening.

See. There's no request for return or replacement of parts in the beginning. Some of you may raise issues with the pickguard but polishing scratches are common and to say that they are not present would be a lie. Anyway, I was trying to deal with him professionally but it didn't happen that way.

This douchebag finally returned the guitar yesterday. I was surprised and relieved to see that the guitar's condition hasn't changed much except for the pickguard. Fogging on the underside of the pickguard he was speaking of turned out to be factory finish(white powdery substance). He tried to wipe the "fogging" without fully removing the guard. No wonder it just stayed there. While I could have retaliated this guy, I reported the receipt of the package to paypal and promised him a refund when the guitar's sold. It'll take some time to sell it because this douchebag left negative feedback on **** and I won't be able to sell there. He'll just have to wait till I sell it and pay him back.
