"The Sony copy-protection software does not install itself on Macintosh computers or ordinary CD and DVD players," Reuters reported today.
There's just one problem with that statement: it happens to be flat-out wrong.

New York Attorney General Warns Over Sony DRM

Things continue to get worse for Sony BMG following the discovery of a rootkit in its CD copy-protection software that degrades PC performance and puts users at risk for security attacks. New York Attorney General Eliot Spitzer, famous for going after corporate corruption and recently spyware companies, has turned his attention toward Sony.
Spitzer sent investigators to a number of retail music outlets, who were able to purchase the affected CDs more than a week after they were allegedly recalled, according to BusinessWeek. Stores including Wal-Mart, Best Buy, Sam Goody, Circuit City, FYE and Virgin continued to stock the rootkit-laden albums.
Over 5 million discs were shipped with the rootkit across 52 different albums, Sony acknowledged earlier this month.
"It is unacceptable that more than three weeks after this serious vulnerability was revealed, these same CDs are still on shelves, during the busiest shopping days of the year," Spitzer said statement.
"I strongly urge all retailers to heed the warnings issued about these products, pull them from distribution immediately, and ship them back to Sony."
Spitzer did not say whether he would file suit against the record label, but he wouldn't be the first. Last week, Texas Attorney General Greg Abbott sued Sony BMG for its use of illegal spyware and disputed claims that it recalled all affected CDs.
Under Texas' Consumer Protection Against Computer Spyware Act of 2005, Abbott is seeking civil penalties of $100,000 for each violation of the law, attorneys' fees and investigative costs.
Spitzer has previously sued Sony BMG over a "payola" scheme that involved sending payments and expensive gifts in exchange for radio airplay. Sony paid $10 million to settle the case in July.

The vulnerability was discovered by the security firm iSEC Partners after EFF requested an examination of the SunnComm software.
"We're pleased that SONY BMG responded quickly and responsibly when we drew their attention to this security problem," said EFF staff attorney Kurt Opsahl. "Consumers should take immediate steps to protect their computers."
"We're grateful to EFF and iSEC for bringing this to our attention," said Thomas Hesse, president, Global Digital Business, SONY BMG. "We believe that the availability of the update coupled with our campaign to notify customers will appropriately address the CDs with MediaMax Version 5 in the market."
SunnComm as well as independent software security firm NGS Software have determined that the security vulnerability is fully addressed by the update. NGS Director Robert Horton said, "After carefully researching the security vulnerability presented to us by SONY BMG, we have determined that it is not uncommon and, importantly, it is easily fixed by applying a software update."
The security vulnerability on SunnComm MediaMax Version 5 software differs from that reported in early November on First4Internet XCP software contained on certain SONY BMG CDs.

is included in the link below. Consumers can download the software update that is designed to address this security vulnerability from SunnComm's and Sony BMG's websites at

The security issue involves a file folder installed on users' computers by the MediaMax software that could allow malicious third parties who have localized, lower-privilege access to gain control over a consumer's computer running the Windows operating system.
SONY BMG will notify consumers about this vulnerability and the update through the banner functionality included on the player, as well as through an Internet-based advertising campaign. The update is also being provided to major software and Internet security companies. EFF and SONY BMG urge all consumers who receive notice to download and install the patch immediately. In accordance with standard information security practices, EFF and iSEC delayed public disclosure of the details of the exploit to provide SunnComm the opportunity to develop an update.

Two new articvles I read today on Slashdot:
1) Even if you declined Sony's EULA, it still installed the Software
News.com is reporting that the Texas attorney general is expanding the allegations against Sony. It seems the software would install even if users declined the EULA. From the article: 'The Texas attorney general said on Wednesday that he added a new claim to a lawsuit charging Sony BMG Music Entertainment with violating the state's laws on deceptive trade practices by hiding 'spyware' on its compact discs ... The new charges brought by Abbott contend that MediaMax software used by Sony BMG to thwart illegal copying of music on CDs violated state laws because it was downloaded even if users rejected a license agreement.'"
2) "In the debate around the anti-piracy bill, the French Parliament voted yesterday into law an amendment to the DADVSI bill that allows free sharing of music and movies over the internet, considering the downloaded files as a private copy. This decision goes against the French government and the music industry's recommendations, who argue the deputies only wanted to show their independence from the government. The initial bill's detractors who pushed for this amendment want a tax for author rights to be paid by everyone on the ISP fees." The French government has vowed to fight this decision
