I am going to get the e-shaft from Evilbay, Need help =)

Hi all!

I have a situation that is about to become nasty invovling that 4 letter swear word auction website.

I sold my last car audion amplifier last week. The guy paid with an Echeck. The funds cleared on Tuesday, I shipped it to him and he got it on Friday.

I get an email today saying that the amp isn't working, and its producing noise through the speakers. He is asking for a full refund on the item.

My dilema:

I looked back at my auction, and I didn't put in a return policy, which to my interpretation, means that I don't accept returns. I don't know how evilbay is going to interpet it yet.

I know once the guy lodges the complaint against me, paypal will take the money out of my account, and he will have the amp and the money. It will then be at his discretion to return the amp or keep it.

My thing is, the amp worked great in my car, and I never had a problem with it. How do I know he didn't install it wrong and blow something up inside of it? In this case, it's his word against mine, and I am pretty sure I know how this is going to end. I am going to get the e-shaft.

Have any of you had something like this happen? Is there any recourse for a seller to take against the buyer returning an item that he claims is broken? Any ideas on what I can do to protect myself, besides stop selling on evilbay?

Well, if you didn't stipulate a return policy, then who is to say that you do take returns? They can't assume that you do or you do not (I would think). Did you say anywhere in the auction it is sold "as-is"? Did you say anywhere to ask all questions before the auction ends? If not, then maybe you should chalk it up as a lesson learned, and tell him you will give him his money back when he sends you the amp back. Maybe he is just an idiot and it is hooked up wrong. Sucks, but at least you will have the amp back and can resell it. Hopefully he didn't blow it.

Sounds like you need to take the "high road", and just offer him a full refund,
upon return of the item (since you have nothing to lose). I've yet to sell
something on the 'bay, but I've bought a few things. Personally, I avoid
the "as-is" auctions, and those high-$$ ones that don't say anything about
the return policy.

The thing that worries me is, he says he won another amp just like it on the bay a few days before. what's to say he didn't swap the guts out of mine and replace it with possibly bad guts out of the other one?

If I take the amp back and he swapped the guts, or blew it, I am screwed =(

I know this is not helping you know, but on used car audio, I put a mark inside the item so I can prove it was the same one sent. Buying an amp of 3bay to swap with a blown one is a common scam.

Hmm, I just checked the buyers feedback, and it says he is no longer a registered user. What does that mean?

Thats probably bad, ever think of taking your cash and closing your paypal account? You could always open another one later.

That's exactly what I did. This was a couple of years ago and some guy paid for one of my auctions via Paypal. I sent him the item then he files a claim for ITEM NOT RECEIVED. However, I had the shipping receipt along with a tracking number as solid evidence. Paypal wouldn't honor it for some odd reason and deposited the money that he paid from my Paypal account back to his. So I filed a fraud case with my local police department [but that didn't do jack...]

I was somehow lucky enough to call up UPS and have them intercept the package and send it back to me. Sometimes Paypal can be a real jerk.

But since then, I've always deposited the money into my bank account after receiving payment. If Paypal withdraws money without my knowledge, you can just file a claim with the bank and that usually works.

Just withdraw all the money in your paypal account. Paypal cant touch your bank account. There are banking laws governing the banks. Paypal has no such laws for protection. I NEVER ship untill I transfer all paypal money to my bank. I also use 2 seperate banks. I use one for paypal and internet buying with very little money in it in case someone goes crazy and hacks it. The other is for my regular banking needs. I wouldnt give the guy anything period.
If paypal suspends your account who cares? There are other ways of transfering money.

Smart, but, wrong.

If Paypal is depositing funds directly into your bank account, they can also withdraw funds from that account. You gave them that power when you linked your bank account.

Just because UPS or FedEx says they something was delivered, doesn't mean it was delivered to the RIGHT address! I just had something of mine delivered 2 blocks east of my street to the same house #. Luckily the person there was honest and called (phone # was on box) and I went over and picked it up.

I think all in all, this situation is a buyer/seller dispute that should be handled between the two parties. The burden of proof, however, lies on the seller, as he has no way to prove it was working before he shipped. (sorry) And as the seller, you have to wonder if the guy didn't do just what you said and swap out the guts? Hopefully it wasn't for a lot of cash and if it does come back, you won't be out too much.

Let us know what happens. Him no longer being a registerred user does bode well IMO, means he has probably done this before and got caught recently.
